The Vilnius reports

Members of Conservative fraction of parliament of Georgia Girogi Tsanava and Kakha Kukava participated in the international conference on the problem of Chechnya, which past in Vilnius under the initiative of the Seym (parliament) of Lithuania in February 24 2006. With the report from the Georgian parliamentary fraction came out Giorgi Tsanava. We represent the complete text of his report. At the same conference with the report came out also Akhiad Idigov, the head of Committee of external communications of Parliament of CHR-Ichkerija, his report is also represented in this rubric.

Dear members of Conference, I greet you on behalf of group of Parliament of Georgia on friendship with Caucasian peoples and Conservative fraction of Georgia and I express the deep appreciation for the invitation to organizers, since for us it is the great honor to be present at this conference. I will try to use optimally the time intended for me and not to bother you by prolonged speech.

1. The newest history of Chechen-Georgian relations.

1.1. In 1991 Georgia declared about its independence. The same year the disorders in the Chechen Republic began. The president of Georgia Zviad Gamsakhurdia was in a fiendly relationship with north - Caucasian peoples and, first of all, with Chechens. Gamsakhurdia declared about the idea of "Caucasian house" which meant the opening of wide front struggle against Russia for independence. In 1992 president Gamsakhurdia officially recognized the independence of the Chechen Republic.

1.2. The situation sharply changed in the period of the presence in the authority of the following President of Georgia Edward Shevardnadze. Shevardnadze supported aggression of Russia and ceded the aerodrome of Tbilisi to the Russian aircraft, which carried out bombardment of the Chechen servicemen. In reply to it the Chechen servicemen took part in the war against Georgia in the territory of Abkhazia.

1.3. The state of affairs changed again, when after the first Chechen war Russia recognized the authority of president Maskhadov. The relation between Tbilisi and Grozny got improved. The embassy of the Chechen Republic were opened in Tbilisi , the president of the Chechen Republic arrived in Tbilisi on official visit , the border was opened and development of economic relations began.

1.4. As soon as the second Chechen war began, thousand Chechen refugees approached the borders of Georgia. The government of Georgia (during this period Georgia already was a member of Euro council) made the decision to grant these people a asylum. Bulk of refugees settled in Pankisi gorge, where kists are living who are in the ethnic and religious point of view related with Chechens. Since then Pankisi became an eternal headache of Moscow, which without the basis declared that in gorge "terrorists" are sheltering themselves. Russia starts bombardment of above named territory. Unfortunately, the European commonwealth could not estimate these facts in appropriate way.

1.5. As well as government of Shevardnadze, the government of present president Michael Saakashvili "endures" the Chechen refugees in Georgia, and an official course of the government remains true to Moscow. Saakashvili considers the struggle of the Chechen Republic for independence as the manifestation of crime and terrorism. For the sake of justice, I will notice: the overwhelming majority of Georgian people concerns to Chechens with the big sympathy.

2. The situation of the Chechen refugees in Georgia.

2.1. In Georgia there is law on refugees, who basically corresponds to the international convention on the status of refugees. However, actually to have the rights fixed in it is very complicated because of the ineffective administrative maintenance. Until now, it does not succeed the delivery of individual documents for the refugees, which prevents them from being moved freely on the territory of the country and beyond the limits of its territory. Because of such heavy conditions, the most part of refugees has already left Georgia though some of them have taken advantage of an opportunity to return to the Chechen Republic, which is caused, by the low level of confidence to prorussian administrations.

2.2. One of most "shameful" problems connected to Chechens, is the ex-tradition of persons of the Chechen nationality to Russia, which the government achieved, with the crude violation of all established procedures. Several times began and was carried out this procedure to those persons, whose names and surnames Russian side noted incorrectly, not to mention the fact that it was not presented any proofs in exposure of these persons in a crime. After a meeting of presidents of Georgia and Russia based on the political agreement, the ex-tradition of some of such persons, who caused anger of the Georgian society, was carried out. Defense counsels of the right addressed in the European court on protection of human rights, which made the decision on a stop of procedures of ex-tradition, and in 2005, the same court declared ex-tradition of the Chechen refugees illegal and assigned a duty to the governments of Georgia and Russia to compensate the moral harm caused to them. After the named decisions, all new procedures of ex-tradition of Chechens have stopped and above activity of Office of Public Prosecutor in this sphere, the judicial control was established.

2.3. The informal ex-tradition of the Chechen refugees was renewed at regime of Saakashvili. For example, in February 2004 Tbilisi court released two refugees who were accused of illegal crossing border after which they immediately disappeared. In several days, these persons were "found at Georgia - Chechen border by the Russian special services and were detained.

2.4. Besides, the arrest of Chechens by the Georgian law enforcement bodies proceeds. The main and standard accusation to refugees consists in illegal crossing border. In spite of the fact that the criminal Code of Georgia forbids the use of given clause in relation to those refugees who want to take advantage of the right of sanctuary, Office of Public Prosecutor after all does not apply the given norm (except for a case of group crossing border during war). Our parliamentary group has already demanded a written explanation on this question, and the next month it is planned the hearing on the general public prosecutor.

2.5. And in other cities of Georgia (for limits of Pankisski gorge) situation of the Chechen refugees is rather complicated. Law-enforcement and administrative bodies of Georgia consider them as a source of a trouble. The non-governmental organizations investigated and published many facts about false arrests and tortures of the Chechen refugees. The Georgian law enforcement bodies frequently apply s. c. Tactics of special operation at which the realization of human rights are roughly broken. In August 2004 during realization of such operation, there were cases of mass beating of the population. Among such persons were 14 women, including - one pregnant. Unfortunately, the government has not estimated this fact negatively.

2.6. Rights of journalists, which for limits of Russia conduct information war against the Russian state terrorism are oppressed. The Ministry for Foreign Affairs of Georgia has given up to the journalist of the Caucasus - center in accreditation, and after a while, the Ministry of Internal Affairs has arrested the same journalist, having presented to him nonexistent accusation.

2.7. The last year the considerable excitement was caused by the application of the Ministry of Internal Affairs for intention to transfer the government of Russia list of the Chechen refugees. As it was supposed, these lists were necessary for the best substantiation of the future ex-traditions for Russia.

2.8. The Russian special services are carrying out a hard work against Chechens in territory of Georgia. In 2004 they have poisoned with the phosphorus scattered in the automobile the leader of representation of Chechen Republic Khizri Aldamov and persons accompanying him. The Georgian police until now have not excited criminal case on this fact.

2.9. Also that circumstance important, when the government does not cooperate with one organization of the Chechen refugees. On demand of Moscow Georgia has forbidden to settle down in Georgia to representation of the lawful government of the Chechen Republic.

3. Participation of the international organizations.

3.1. The control of the international organizations of protection of rights of the Chechen refugees is carried out poorly, that is caused s.c. "chechenofhobia". In spite of the fact that any protest action against the government of Georgia and local office of the United Nations was carried out, the freedom of movement of Chechens till now is not provided, and the control of this process carries out local representation of the United Nations.

3.2. As it was marked above, positive influence on protection of rights of refugees had the case decision of the European court.

4. A political estimation.

4.1. Toward the end we would like to express our political relation to chechen -russian conflict. Our political group supports struggle of Chechen people for independence and self-determination. We express the discontent in relation to those members of the international commonwealth which because of the certain mercenary motives qualify struggle of Chechens as terrorism.

4.2. At the same time, we count, that the today's military conflict, alongside with exile and rough infringement of rights, causes physical destruction of Chechen people.

4.3. It is formed s. c. Impasse: on the one hand, Russia recognizes only the right of the Chechen Republic on autonomy (though it so to say, dead idea -), and, on the other hand, Chechens refuse this right and do not accept any status, except for full independence.

4.4. We do not call Chechen people to stop or to not stop struggle by today's methods, however, if struggle and peace political methods will begin, it considerably will facilitate the help to the international cooperation though we understand; similar activity is connected to that danger.

We wish Chechen people in the near future to gain a full victory in this long, but heroic war against the most malicious empire of mankind.

Refusal by the West of recognition of independence of CHR-Ichkerjia and its consequences.

Dear Friends, ladies and gentelmen!

Chechen people, is one of the most ancient nations of the world, during many centuries conducts struggle for the survival. In the different periods of the history, Chechens had the state. In 19 and 20 centuries our people was under the Russian imperial oppression, but also in this period, it from time to time restored the statehood. It is typical, that our people never stopped struggle for the independence, being even under colonial oppression. We understand that each nation aspires to declaration of the state, and this way there is a wide experience of many nations of the world. It is enough to result examples of struggle of Baltic peoples and peoples of Caucasus. 

At the beginning of the period of disintegration in 1990 of the Russian empire - the USSR, Chechen people, as well as many peoples from this empire, took advantage of the natural right and proclaimed about a reconstruction of the state according to modern international law. Typically for this period, that our people carried out in November 25, 1990 a referendum (the National congress of Chechen people) and proclaimed the independent Chechen state. Operating on the international rules, Chechen people carried out elections of authority - President D.Dudaev and parliament of the country in October 27, 1991. And it is a unbiased fact of legality of formation of the independent Chechen state that was confirmed with observers from many countries of the world. The government was generated and March, 12, 1992 the Constitution of the sovereign independent legal democratic Chechen state was accepted.

The next elections of the president and parliament passed in January 27, 1997 and again these elections passed according to legislation of CHR-Ichkerjia. These elections were passed under the supervision of representatives of many countries of the world and under patronage of OSCE. The continuity of authority of CHR-Ichkerija was kept, these elections were recognized also by Moscow. However, recognition of CHR-Ichkerjia has not followed for the first time, in the subsequent, except for recognition of our state the lawful government of Georgia of Z.Gamsakhurdia March 13, 1992. In these conditions of the international isolation the Chechen government did the utmost to keep our state which existence is considered by us as the next stage for purchase of a guarantee of preservation of Chechen people. We see the prospering future of people only in community of the countries of other world.

Starting from this fact, Chechen people proclaimed the statehood by the acceptable methods, we count that the international community has not carried out the obligations to Chechen people, having given up in recognition of existence of its state. It is similar to treachery and a withdrawal from the principles accepted for regulation of mutual relation in the world. We are asked a question: - Why did it refuse in recognition to the Chechen state when such recognition was received with other peoples from the failed Russian empire? Unless the international law corresponds not to all peoples and the states of the world? We set this question and to those states, which have managed to dump, yoke the Russian empire by means of the international community. Unless they should not act as a united front in protection of Chechen people which being conformed by the same rules and under the right have proclaimed the independence? We declare, that accomplished against our people infringement of the right of Chechen people internationally was not simple, it was something the greater - this was a mistake.    

The first this mistake present Moscow, which has inherited essence of the Russian empire, has decided to take advantage. This country made in November 26, 1964 aggression against the Chechen state, and today we have tormented Chechnya, the country in which the aggressor has killed more than 25 percents of the peaceful population. As much people became refugees, Chechens are pursued to an ethnic attribute on all occupied Chechnya and in the territory of Russian FEDERATION - RUSSIA. Ethnic clearings of Chechens accompanied unprecedented violence, cruelty and sadism, planned in the Kremlin, are usual working business of criminal Russian armies and their puppets this implies, that we may ascertain about presence of a policy of destruction of Chechen people that refers to as genocide. And it means, that RUSSIAN FEDERATION - RUSSIA makes heaviest crime against humanity. And against this crime made by Russian FEDERATION - RUSSIA, proceeding during all these years, in the world do not undertake though any steps of counteraction, except for declarative, nothing of applications meaning for the Kremlin.  

Worldwide many Chechens have parted rescuing lives of children, in search of protection and all Chechen people. They hopelessly try to punch thickness of indifference on the part of Europe; the situation in the countries of the CIS is even more hopeless. Today, after the lapse of 14 years, from time of refusal of a recognition of the Chechen state, the situation in Chechnya is worsened and it is not visible a gleam in its decision. We count, that the main originator of criminal position in Chechnya is RUSSIAN FEDERATION - RUSSIA. There is all this of that the western states is aimed work on corporation which aspire to master the petroleum for petroleum and gas markets of Russian FEDERATION - RUSSIA.

As a result, there is no gleam in the field of observance of human rights in all spheres of life in RUSSIAN FEDERATION - RUSSIA, and it directly influences that the situation with war against Chechnya is aggravated. The west all these years will carry out a notorious "real-policy" in hope to tame RUSSIAN FEDERATION - RUSSIA, but in practice there is the opposite: and behavior of the Kremlin more and more energetic.       

The Russian government pursues a policy of a full distortion of the valid state of affairs in Chechnya, naming the crimes antiterrorist operation. The Kremlin plays scheduled scripts in which many puppets from persons of the Chechen nationality participate, and also taking place to a captivity at Russian Chechens. Under a face of fighters of Resistance, they are used by Moscow in the draws for making a fool of public opinion of Chechens and the population of Russian FEDERATION - RUSSIA.

Many of these "fighters" are entered into error, the opinion on legitimacy of actions of the Russian forces of occupation in the territory of Chechnya thus is created, and the pretext for the greater and greater distance of chapters of the states of the West from a problem of Chechen people is created. Attempts to pervert the settled opinion on a spent genocide of Chechen people from here are made. Name all Chechen people - about people a criminal ", people unable to have the own state. The policy of the state terrorism of Russian FEDERATION - RUSSIA is aimed at hiding the true essence through involving in it a field of action of Chechens and people of other nationalities of Northern Caucasus. Image of Chechen people in the world is undermined and more and more isolation of Chechen people amplifies.

This circumstance is aggravated also by that, the religious moment is involved in a revolution. Struggle of Chechen people against invaders more and more appears the Kremlin, as antiterrorist war against radical islamists. Chechen people profess Islamic religion and there is nothing strange, that they address to the God, appearing in so close vice of the international isolation. This moment politically untwists the Kremlin under the program; it began to name the genocide war against Chechen people a part about struggle against the international Islamic terrorism of item. Thus, the religion is used by Moscow for simplification of the terrorist activity, and Chechen people for the protection. This paradox when it is not visible the end to this opposition is created exclusively by that, the right of Chechen people on recognition of its statehood in 1991 was broken at the international level. 

As it is known, RUSSIAN FEDERATION - RUSSIA in March 8, 2005 killed also third, lawfully elected President of CHR-Ichkerjia Maskhadov. All life of this person was directed on putting an end to war round a negotiating table. He called for this the international community, called for this and RUSSIAN FEDERATION - RUSSIA. For it, he was killed. War is necessary for the Kremlin, it plays it in Chechnya, and now transfers to all Northern Caucasus, involving here the international influence both all militarian and a police arsenal. Whether Moscow will make here success whether or not depends and on the West. However, it is abundantly clear, that this game may be wrapped up for RUSSIAN FEDERATION - RUSSIA and the return side - RUSSIAN FEDERATION - RUSSIA may fail on an example of the USSR.       

 All this became possible also because Chechnya became a zone of inviolability for international right protecting organizations and independent press. In our opinion, such infringement of activity is inadmissible from the point of view of international law. The Russian Federation - Russia has signed the appropriate international Conventions, but is open them breaks. Besides the situation did not begin to develop aside democratization in RUSSIAN FEDERATION - RUSSIA, and opposite, the planned recourse was threw and on the western countries. Moscow dexterously tries to transfer the "experience" on territory of the western states. It is evident we see with the provocation untwisted in the world, in connection with comical figures on Prophet Muhammad.                 

On all it is visible, that the constant struggle occurring between separate forces in the world, still it is possible to cover with a screen of struggle against the international terrorism. Actually executors and customers of it about process of covering“ are other forces far from interests of peoples, as in their country of residence, and all over the world. Their values are others, and are called by them - money and authority. I think that not far that time when true players of these processes will be highlighted at strengthening of struggle for influence in the world, and this time is not far off.  

The Russian Federation - Russia declaring values of democracy and a good-neighborhood with all countries, even more becomes menacing force for the neighbors as it was even during the USSR. Not without reason, many countries from the former USSR aspire to leave from this neighborhood under a wing of Europe. And in it has played a considerable role the policy of the West on suppression and protection of the Kremlin.
